WILL I GO TO JAIL IF I WAS CAUGHT SHOPLIFTING?

I recently had someone in my office who had been charged with shoplifting from a local mall. They wanted to know what type of crime they could be charged with, and what the possible penalties would be. The State of New York considers theft under $1,000 – which would obviously include the shoplifting with which this individual was charged – is called petit larceny. As such, it is an A misdemeanor which is punishable by up to one year in jail and a $1,000 fine.

When the individual expressed surprise that the penalties could be so severe, I tell them, “It's very important to hire a criminal defense attorney in Buffalo NY to help you deal with such charges because an attorney can obtain either a reduction of the charges or possibly a complete dismissal.”
