Arrests for possession of marijuana in Buffalo – or anywhere in New York State – are divided into two different classes of offense. One is designated “unlawful possession of marijuana” and is a violation which carries a maximum fine of $100.

The other, “possession of marijuana over 25 grams,” is actually a misdemeanor punishable by up to one year in jail.
