WHAT ARE THE PENALTIES FOR A DWI CONVICTION?

The other day, in my Buffalo office, I met with someone who was charged with DWI. When they asked whether they actually needed an attorney – since they were only charged with DWI. Unfortunately, I had to make them aware of their potential consequences. For example, even a first DWI carries severe consequences. First, let's think financially. A person convicted of DWI will receive a fine of $500 or to $1,000 plus surcharges. The driver's license will be revoked for a period of six months to one year, and an ignition interlock device requiring a breath sample before starting will have to be installed in any vehicle you operate. Finally, the court may also impose probation for up to three years, and up to one year in jail.
