FREQUENTLY ASKED DWI QUESTIONS:

Q. Can a DWI Charge Dismissed if I Was Never Read My Miranda Rights?

A. While we oftentimes see officers reading the Miranda rights to individuals when they are first arrested on TV and in movies, it is important to remember that they are relevant for some things but not for others. With regard to any statements that you may have made, it is important to remember whether or not you were read your Miranda rights. Miranda applies to what's called custodial interrogation, and it states that if you answered questions that tended to incriminate yourself while you were not free to leave, those statements may not be allowed into court.

FREQUENTLY ASKED TRAFFIC TICKET QUESTIONS:

Q. What are the Penalties of Leaving the Scene of an Accident?

A. Although this is an infraction – and not a crime – it is punished by up to 15 days in jail and a $250 fine. If you find yourself in this situation, it is very possible that an attorney can work with the prosecutor to get your charge reduced to a lower violation and avoid your having to spend time in jail or pay the fine.
