Q. Can You Get a DWI on a Boat?

A.  One of the great things about living in western New York is that there are so many great places you can go in a boat. If you are out on your boat, however, it is important to realize that the crime of BWI – boating while intoxicated – does exist, and it carries a lot of the same penalties as DWI. That means it's important to hire an attorney if you are ever charged with BWI. While your driver's license will not be suspended, if you have prior DWIs, the court will consider that when determining the sentence you will receive in your BWI case. Also, if you've had a BWI conviction and are later charged with DWI, that BWI conviction will be used in determining your sentence for that DWI.


Q. What are the Penalties for Speeding?

A.  Points for speeding start at three points for one to ten miles per hour over, and they can go up from there to four, six, eight, and even eleven points. That's important because, if you receive 11 points in 18 months, your license will be suspended. Also, points levied against your license will impact the rate you pay for your insurance. If you are cited for speeding, it's important to hire an attorney to attempt to reduce those points – or even have them removed altogether.
