In the state of New York, criminal mischief is the term used to describe vandalism and the penalties vary based on the amount of damage the individual caused. Damage of $250 or less is considered an A misdemeanor and the crime is punishable by up to one year in jail. Damage valued at more than $250 means the charge is elevated to a felony and the penalties include more than one year in jail as well as fines and the potential of being placed on probation for a period of time. I emphasized to this parent that it was very important for them to meet with an attorney who handles these types of cases in order to obtain the best results and help defend their child.
