FREQUENTLY ASKED DWI QUESTIONS:

Q. Can a DWI Charge Dismissed if I Was Never Read My Miranda Rights?

A. While we oftentimes see officers reading the Miranda rights to individuals when they are first arrested on TV and in movies, it is important to remember that they are relevant for some things but not for others. With regard to any statements that you may have made, it is important to remember whether or not you were read your Miranda rights. Miranda applies to what's called custodial interrogation, and it states that if you answered questions that tended to incriminate yourself while you were not free to leave, those statements may not be allowed into court.

FREQUENTLY ASKED TRAFFIC TICKET QUESTIONS:

Q. What are the Penalties for Speeding?

A.  Points for speeding start at three points for one to ten miles per hour over, and they can go up from there to four, six, eight, and even eleven points. That's important because, if you receive 11 points in 18 months, your license will be suspended. Also, points levied against your license will impact the rate you pay for your insurance. If you are cited for speeding, it's important to hire an attorney to attempt to reduce those points – or even have them removed altogether.
