CAN I GET MY DWI CASE DISMISSED IF I WAS NEVER READ MY MIRANDA RIGHTS?

Oftentimes, when I meet with individuals in my office for the first time, they indicate that they were not read their Miranda rights. Because of that, they believe their case should be dismissed. While we oftentimes see officers reading the Miranda rights to individuals when they are first arrested on TV and in movies, it is important to remember that they are relevant for some things but not for others. With regard to any statements that you may have made, it is important to remember whether or not you were read your Miranda rights. Miranda applies to what's called custodial interrogation, and it states that if you answered questions that tended to incriminate yourself while you were not free to leave, those statements may not be allowed into court. It's important to meet with an attorney and go over any statements you may have made when charged with DWI or any other criminal offense.
