I often meet with individuals who ask me if they can receive an ACD for their case. An ACD is an adjournment in contemplation of dismissal, which is sometimes offered by the district attorney’s office when an individual has no prior record – or a very limited prior record – and the crime is not very serious. In an ACD, the court imposes a condition on the offender, such as restitution, completion of a drug treatment program, or simply remaining arrest-free for a specified period – usually six months or one year. If the individual complies with those conditions successfully, their charge will be dismissed and the record of it sealed by the court.
