The other day, I received a phone call from an individual in Buffalo who said they had received a traffic ticket for reckless driving. After talking with the individual, I had the sad duty of informing them that, in fact, they were facing a criminal charge punishable by up to 30 days in jail and five points on their driver’s license. A few days later, I met with them to discuss the facts and circumstances regarding their case and the possible defenses. While the facts and circumstances of every case are different, we were able to have this person’s charge reduced to a noncriminal violation, thereby protecting their criminal record and allowing them to answer, “No,” when an employer asks, “Do you have any criminal convictions?”
