A.  In 2009, the New York State Legislature passed Leandra's Law which has exerted a dramatic influence on all DWI cases by establishing two very important things. First, the breath alcohol limit was reduced from .10 to .08, which obviously affects a number of drivers. The other impact of Leandra's Law addresses passengers in your vehicle. If you're arrested for DWI with an individual who is 15 years of age or younger in your vehicle – even for a first offense DWI – you will be charged with a felony.
